Work permits in Poland for employers and employees

We prepare work permit applications for companies hiring foreign talent and for foreigners taking a job in Poland, under the rules in force since June 2025.

Short answer

Most non-EU citizens need a work permit or another legal basis to work in Poland. The employer usually applies to the voivode for the permit. Since 1 June 2025, applications are filed only electronically through praca.gov.pl and the labor market test no longer applies, although local authorities can restrict permits for listed occupations. Some foreigners can work under a simplified declaration, a combined residence and work permit, or are exempt.

The 2025 reform

On 1 June 2025, Poland introduced a new act on employing foreigners. Two changes matter most in practice. First, the labor market test was abolished: employers no longer need to show that no Polish or EU candidate was available, although local authorities may publish lists of occupations where permits can be refused. Second, all applications for work permits and declarations are filed electronically through praca.gov.pl. Paper filings are not examined.

Which basis applies

Not every foreigner needs a classic work permit. Depending on nationality and status, the right basis may be a work permit obtained by the employer, a combined temporary residence and work permit for someone living in Poland, a declaration on entrusting work for citizens of certain countries, or an exemption, for example for some graduates of Polish universities or holders of permanent residence. Picking the right one saves months.

Employers carry ongoing obligations: matching the terms in the permit, notifying the authorities of certain changes, and keeping documentation. Frequently asked questions

Who applies for a work permit, the employer or the employee?

For a standard work permit, the employer applies. For a combined residence and work permit, the foreigner applies, with documents from the employer.

Is the labor market test still required?

No. The labor market test was abolished on 1 June 2025. Local authorities can instead publish lists of occupations where permits may be refused.

Can I apply on paper?

No. Since 1 June 2025, work permit applications and declarations must be filed electronically through praca.gov.pl.

Can I change employers on a work permit?
